JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-03-2019 The petitioners apprehend their arrest in connection with Buxar Muffasil P.S.Case No. 240 of 2018 registered under Sections 302, 341 and 342/34 of the Indian penal Code. Allegation as per the FIR is of murder of the father of the informant and petitioners are not named in the FIR. Later on, during investigation they are named in the FIR. Submission of learned counsel for the petitioners is that except suspicion, there is nothing against them and they have been falsely implicated in this case and other co-accused has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 28.01.2019 passed in Cr.Misc. No. 449 of 2019.
Patna High Court CR. MISC. No.80804 of 2018(5) dt.05-03-2019 2/2 Heard learned APP also and learned counsel appearing on behalf of the informant, who have opposed the prayer for bail stating that sufficient material has come during investigation that petitioners were working as liner to accused persons while fleeing away.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Buxar Muffasil P.S. Case No. 240 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioners shall co-operate in investigation.
