2. This application has been filed for modification of the order dated 19.11.2024 passed in CWJC No. 11177 of 2018, seeking extension of time granted for filing representation with proper NOC before the Managing Director, Bihar State Housing Board, Patna.
3. Learned counsel for the petitioner submits that by virtue of judgment dated 19.11.2024 (Annexure P/1), liberty was granted to the petitioner to file fresh representation with
Patna High Court MJC No.4450 of 2024(5) dt.18-07-2025 2/3 proper NOC before the Managing Director, Bihar State Housing Board, Patna / concerned authority within a period of four weeks from the date of receipt of this order. It was further directed that if petitioner raises his grievance before the concerned authority by filing representation within the stipulated period, the concerned authority shall pass appropriate order on the representation of the petitioner in accordance with law after hearing the parties concerned, preferably within eight weeks from the date of representation of the petitioner.
Learned counsel further submits that the present modification petition has been filed with limited prayer to extend the period of filing the representation as petitioner failed to submit the representation with proper NOC before the concerned authority within stipulated time as the brother of petitioner, namely, Kedar Nath Amrit resides and works as Communication Agent in a company under the Name and Style of Smart Mechanical Equipment Trading Ltd. (SMET) at Abhu Dhabi in United Arab Emirates (U.A.E.), as stated in para 5 of the petition. Hence, learned counsel for the petitioner prays to extend the time for filing of representation to the period of twelve weeks.
5. Learned counsel for the State as well as Housing Board does not controvert the submission of the learned counsel
Patna High Court MJC No.4450 of 2024(5) dt.18-07-2025 3/3 for the petitioner.
6. In the light of aforesaid facts and circumstances, the time granted for filing the representation before the Managing Director, Bihar State Housing Board, Patna / concerned authority for redressal of his grievance is extended for a period of twelve weeks.
7. The order dated 19.11.2024 passed in CWJC No. 11177 of 2018 stands modified to the above extent.
