The petitioner seeks regular bail in connection with Buxar Town P.S. Case No. 603 of 2019 for the offence punishable under Section 392 of the Indian Penal Code. The allegation is regarding unknown miscreants having committed loot of ornaments worth Rs. 30 Lacs from the shop of the informant.
The learned counsel for the petitioner has submitted that petitioner is innocent and is himself the owner of the adjacent jewelry shop and has been implicated in the present case on account of business rivalry. The learned counsel for the petitioner has further submitted that though the petitioner is accused in one case, but he is on bail in the said case and he is
Patna High Court CR. MISC. No.79267 of 2019(2) dt.13-01-2020 2/2 in custody since 13.10. 2019. Lastly, it is submitted that the main accused has already been granted bail by a co-ordinate Bench of this Court by an order dated 4.11.2019 passed in Cr. Misc. No. 65601 of 2019.
Having regard to the facts and circumstances of the case, considering the submissions advanced by the learned counsel for the petitioner coupled with the fact that the main accused has already been granted bail by a co-ordinate Bench of this Court and no recovery of stolen article has been made from the conscious possession of the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 603 of 2019 corresponding to G.R. No. 2195 of 2019.
