====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Maranchi P. S. Case No. 82 of 2021 in a case registered for the offences punishable under Sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per F.I.R., co-accused Ajay Nishad fired bullet upon father of the informant, as a result of which he died.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and he has been made accused in this case only on the basis of confessional statement of co-accused. There is no specific accusation of any overt act against the petitioner. It is further submitted that similarly
Patna High Court CR. MISC. No.87166 of 2025(2) dt.22-12-2025 2/2 situated co-accused, namely, Lango Bind has already been granted regular bail by co-ordinate Bench of this Hon'ble Court vide order dated 19.01.2023 passed in Cr. Misc. No. 30535 of 2022. Petitioner is in custody since 16.11.2024.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-III, Barh, Patna in connection with Maranchi P. S. Case No. 82 of 2021.
