JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-06-2022 Though the present writ petition was filed for payment of death-cum-retiral dues, however, it appears that during the interregnum period, the respondent Bank has paid a sum of Rs. 1,58,378 towards gratuity, a sum of Rs. 2,45,248/- on the head of provident fund and an ex-gratia sum of Rs. six lacs. It is also submitted by the learned counsel for the respondent Bank that family pension is also being paid to the widow petitioner.
At this juncture, the learned counsel for the petitioner submits that though in Annexure-1 to the counter affidavit, which is the calculation chart, it has been mentioned that the total service period of the deceased employee is 26 years, five
Patna High Court CWJC No.3679 of 2018(6) dt.23-06-2022 2/2 months and 28 days, however, only meagre amount of Rs. 1,58,378.00 has been paid towards gratuity, hence the petitioner be granted liberty to agitate her subsisting grievance before the concerned authority.
Accordingly, the present petition stands disposed off with liberty to the petitioner to agitate her subsisting grievances, if any, before the respondent Bank.
It is needless to state that in case appropriate representation is filed within a period of four weeks from today, the same shall be disposed off by passing a reasoned and a speaking order within eight weeks thereafter and in case any outstanding dues are found payable, the same shall be paid forthwith.
