1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehend her arrest in connection with Katra P.S. Case No. 166/2020 dated 30.07.2020, registered for the offence punishable under Sections 304(B), 201 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner has been falsely implicated in a case relating to dowry death. It is next submitted that the petitioner is not related to the husband of the deceased and from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant is not an eyewitness to the occurrence and a general and omnibus allegation of committing the murder of the deceased by poisoning has been alleged against all the accused persons including the petitioner. The learned counsel asserts and submits that the petitioner is not related in any manner with the family of the husband of the

It is next submitted that similarly situated co-accused namely Wakil Mahto and Neelam Devi had moved this Court by filing Cr. Misc. No.56924/2023, seeking anticipatory bail, which was allowed by a learned co-ordinate Bench by an order dated 19.09.2023 (Annexure-3).

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner that the petitioner is not related to the family of the husband of the deceased and the allegations are also not specific, as such, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Kumari Savitri, learned J.M. 1st Class, Muzaffarpur in connection with Katra P.S. Case No.166/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
