JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioners seek anticipatory bail in connection with Makhdumpur P. S. Case No. 223 of 2015, registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier prayer for anticipatory bail of the petitioner was rejected by this Court, vide order dated 25.06.2018 passed in Criminal Misc. No. 20170 of 2018.

Submission of the learned counsel for the petitioners is that thereafter, final form has been submitted, not finding the case true, but the cognizance has been taken against the petitioners.

Heard learned APP also.

Patna High Court CR. MISC. No.81174 of 2019(2) dt.05-02-2020 2/2 Having heard both sides, in the present case almost one and half years prior anticipatory bail of the petitioners was rejected with a direction to the petitioners to surrender before the court below within a period of three weeks and now after such a long time, again this anticipatory bail application has been filed.

Considering the above, I am not inclined to grant bail to the petitioners, however, he has to surrender and pray for regular bail, the same shall be considered on the basis of the materials available on the record.

With the above observations, this application is dismissed.
