====================================================== CORAM: HONOURABLE MR. JUSTICE SOURENDRA PANDEY ORAL ORDER 05-05-2025 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with Naubatpur P.S. Case No. 402 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 74, 109, 352, 3(5) of the B.N.S. and 27 of Arms Act.

3. The allegation against the petitioner is that he along with other had assaulted the mother of the informant with lathi and danda and subsequently, one Kunkun Kumar had shot from the country-made pistol upon the informant.

4. Learned counsel for the petitioner submits that there is general and omnibus allegation of assault on the mother of the informant while the allegation of firing is upon one Kunkun Kumar. Learned counsel further submits that the

Patna High Court CR. MISC. No.3590 of 2025(3) dt.05-05-2025 2/2 petitioner is 70 years old and there is no specific allegation of over act against the petitioner. Lastly, learned counsel for the petitioner submits that petitioner is in custody since 21.07.2024.

5. Learned Additional Public Prosecutor for the State has opposed the prayer for bail.

6. Considering the aforesaid submissions made by the parties and taking into consideration the fact that there is general and omnibus allegation against the petitioner and also considering the fact that petitioner is in custody since 21.07.2024, I am inclined to grant the petitioner privilege of regular bail.

7. Accordingly, the prayer for bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Additional Chief Judicial Magistrate-VI, Danapur, in connection with Naubatpur P.S.
