JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 By way of present appeal, appellant seeks regular bail in connection with Jaipur P.S. Case No. 28/2019, registered for the offences punishable under Sections 341, 323, 385, 504, 506/34 of the Indian Penal Code and Section 3/4 of the SC/ST Act.

As per F.I.R., appellant said to have assaulted the informant and demanded Rs. Fifty Thousand as Rangdari. Submission of learned counsel for the appellants is that he has falsely been implicated in this case and he has no criminal antecedent and has been in judicial custody since 05.09.2019 and chargesheet has been submitted and there is no chance of tampering with the evidence.

Having heard both sides, considering the facts and

APP (SJ) No.5426 of 2019(2) dt.10-12-2019 2/2 circumstances of the case, this appeal is allowed and impugned order dated 14.11.2019 passed by the learned Additional Sessios Judge-I, Banka in G.R. No. 75/2019 (Corresponding to Jaipur P.S. Case No. 28/2019) is set aside, let the appellant above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -I, Banka, in connection with Jaipur P.S. Case No. 28/2019.
