2. The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 341, 323, 324, 307, 379, 504 of the Indian Penal Code.
3. It is alleged that this petitioner alongwith other coaccused persons assaulted informant and his mother by means of stick, iron rod and knife, due to which, they sustained injury.
4. Learned counsel for the petitioner submits that as per F.I.R., this petitioner alongwith co-accused Haresh Kumar assaulted informant with iron rod, but there is no injury report on record to substantiate the allegation. Both parties are Gotiyas. Similarly situated co-accused Haresh Rai and Shashi
Patna High Court CR. MISC. No.5310 of 2025(4) dt.01-07-2025 2/2 Kumar have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 12.04.2022 passed in Cr.Misc. No. 27162 of 2021 (Annexure P/2). Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Barhara P.S. Case No. 18 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
