2. The petitioner seeks bail in a case registered for offence under Section 376 of the Indian Penal Code.

3. As per prosecution case, while daughter of informant was alone at her house, this petitioner came and committed rape upon her and thereafter, fled away.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Allegation, made in the F.I.R., is concocted and frivolous. F.I.R. has been lodged after a delay of 45 days and there is no plausible explanation of delay. As a matter of fact, petitioner had filed a case, vide Dumraon P.S. Case No. 70/2024, against the victim and her family members, wherein, he has alleged that accused persons have cut the private part of this petitioner and in retaliation, this false and concocted case has been lodged.

Patna High Court CR. MISC. No.90301 of 2024(3) dt.04-07-2025 2/2 Petitioner is in custody since 29.09.2024.

5. Learned A.P.P. for the State vehemently opposes the prayer for bail.
