2. The petitioner is in custody since 28.07.2023 in connection with Kasim Bazar P.S. Case No. 134/2023 registered for the offence punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the victim has been assaulted by fire arm which hit the stomach of the victim.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner is not the assailant of the victim, but co-accused Gulu Kumar had fired on the victim. The petitioner is said to have caught hold of the victim.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.1850 of 2024(2) dt.18-01-2024 2/2 behalf of the State has vehemently opposed the prayer for bail.

Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No. 134/2023.

7. The petitioner is directed to mark his attendance in Kasim Bazar P.S. on 1st Sunday and 4th Sunday of every month failure to do so, will result in cancellation of bail bond of the petitioner.
