The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in a case registered for the offence under sections 272, 273 and 34 of the IPC and 30(a) of Bihar Excise Act, 2016.

As per allegation in the FIR 50 litres of country liquor is said to have been recovered from a field. It is stated that the petitioner and his son managed to escape leaving behind the articles.

It is submitted on behalf of learned counsel for the petitioner that neither petitioner was caught at the place of occurrence nor does he or his son have anything to do with the same. The petitioner has no criminal antecedent.

The petitioner above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Hilsa P.S. Case No.350 of 2019 is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Third Additional Sessions Judge-cumSpecial Judge (Excise), Nalanda at Biharsharif subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
