2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 307, 324, 354, 379, 504, 506 and 34 of the Indian Penal Code and Section 27 of Arms Act.

3. As per the prosecution story, the informant alleged that due to land dispute, her nephew, petitioner No. 2 and Jairam Singh called her son, Amresh Kumar and during the alleged measurement, after abuse, they resorted to assault. When this was objected to, allegation is that Jairam Singh opened fire causing injury to her son, further , petitioner no. 2 gave 'kudal' blow on the chest of her son, the same allegation is on Kanchan

Patna High Court CR. MISC. No.89787 of 2024(2) dt.03-04-2025 2/2 Devi who injured the hand of her son whereas, petitioner No. 1 gave blow on his head.

4. Learned counsel for the petitioners submits that during land measurement, scuffle took place between the parties in which co-accused Jairam Singh caused firearms injury. Injuries allegedly caused by these petitioners are simple in nature. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State as well as learned counsel for informant vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P. S. Case No. 325 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
