1. Heard the parties.

2. Petitioner seeks regular bail in connection with Tajpur P.S. Case No. 228 of 2024 dated 17.10.2024 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 (Amended).

3. As per the prosecution story, on secret information the Police intercepted a car and recovered 90 liters of illicit liquor from the same. The petitioner along with others succeeded in fleeing away. The petitioner was identified by the Chaukidar.

4. Learned counsel for the petitioner submits that the petitioner is not the owner of the car in question. The name of the petitioner has been disclosed by the village Chaukidar. Illicit liquor has not been recovered from the conscious possession and/or vehicle belonging to the petitioner. The petitioner is in

Patna High Court CR. MISC. No.1505 of 2025(2) dt.27-01-2025 2/2 custody since 16.11.2024 and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail. Some of the accused persons have been granted anticipatory bail vide Annexure P-3.

Regard being had to the submissions made by the parties, taking into consideration the fact that the car from where illicit liquor has been recovered does not belong to the petitioner, the petitioner is in custody since 16.11.2024, the co-accused persons have been granted anticipatory bail by this court and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail, I am inclined to grant regular bail to the petitioner.

6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-02, Samastipur in connection with Tajpur P.S. Case No. 228 of 2024.
