2. Petitioner apprehends their arrest in a case registered for the offence punishable under sections 303 ( 2 ) of Bhartiya Nyay Sanhita 2023 .

3 . As per the prosecution case , on the alleged date and time of occurrence , when informant parked his motorcycle in front of his rental house and when he returned after taking meal, he did not find his motorcycle .

4. It is submitted on behalf of the petitioner that name of the petitioner transpired on the confessional statement of coaccused Munna Yadav with whom petitioner has inimical terms . Stolen motorcycle of informant has been recovered from com co-accused Bechan Kumar. Nothing has been recovered

Patna High Court CR. MISC. No.89096 of 2024(2) dt.21-01-2025 2/2 from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

6 Considering the fact nothing has been recovered from the conscious possession of the petitioner, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Rohtas Sasaram in connection with Sasaram ( T ) ( Darigaon) P.S. Case No. 611 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
