2. The petitioner has prayed for bail in connection with Lakhaura P.S. Case No. 21 of 2025 registered for the offence punishable under Sections 64, 303(2) of the B.N.S., 2023.

3. The case of the prosecution in short is that the petitioner has established physical relationship with the informant for three years, and when she got pregnant, he denied marrying her. It is further alleged that the petitioner has taken Rs. 20,000/- for marriage.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner submits that in this case, there is no date of occurrence in the FIR. As per the case of the prosecution, the physical relationship was established over the last three years, but the informant has not complained. It has also been submitted that in this case, the informant is a major, and the period for which there is an allegation that they were in a physical relationship itself goes to show that the relationship was a consensual one. Though during the course of the investigation, the victim has supported the case of the prosecution but the manner in which the case has been filed itself creates doubt on the occurrence. He further submits that a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 06.05.2025.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named

Case No. 21 of 2025.
