2. The present application has been filed for directing the respondents to remove the encroachment from public road concerning Khata No. 204 Old Khesra No. 747 Old Khata No. 319, New and Khesra No. 1029 New, area-30 decimal at Mauza Konaila, Thana 47, Block Dalsinghsarai, Samastipur.

3. In the facts of the case, the Title Appeal No. 23 of

Patna High Court CWJC No.13642 of 2018(3) dt.25-04-2024 2/2 2008 is directed to be disposed of by the Additional District Judge, Samastipur who is assigned with the Title Appeal.

4. The appeal must be disposed of within three months from the date of communication of a copy of this order by hearing all the concerned parties and the appellate Court will proceed ex parte against the non-cooperating parties.

5. With the aforesaid observations and directions, this application is disposed of.
