1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Jadopur P.S. Case no.30 of 2021 registered under sections 302, 201 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that his son went with two persons on a motorcycle. Subsequently he received information on his mobile phone about the murder of his son.

4. Learned counsel for the petitioner submits that the F.I.R. was registered against unknown accused persons. The petitioner was falsely implicated in course of investigation. The prosecution is mainly relying on the CDR of the mobile phones as also the confessional statement of the petitioner himself

Patna High Court CR. MISC. No.380 of 2024(3) dt.19-03-2024 2/2 which was made before police and no recovery of any incriminating article has been made as a result of the said statement. The petitioner is in custody since 4.9.2023 and chargesheet has been submitted in the case. He has no criminal antecedent.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the material that has transpired in course of investigation, the petitioner being in custody for 6 months since 4.9.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Jadopur P.S. Case no.30 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Chief Judicial Magistrate, Gopalganj.
