2. The petitioner has moved this Court once again seeking regular bail in connection with Salaiya P.S. Case No. 35 of 2018 registered for the offences punishable under Sections 386, 387/34 of the Indian Penal Code, Section 34 of the Explosive Substances Act, Sections 25(1-B)a, 26 and 35 of the Arms Act and Section 17 of the Criminal Law Amendment (CLA) Act. He has got 14 criminal antecedents. He is in custody since 13.07.2018.

3. Earlier, his prayer for bail was rejected vide order dated 26.11.2019 passed in Criminal Miscellaneous No. 74139 of 2019. The operative part of the said order reads as under:- "Considering the facts and circumstances of the case wherein it appears that the charges have already been framed against the petitioner and other accused and the petitioner has got as many as 14 cases on his head of similar nature and of serious nature

Patna High Court CR. MISC. No.2923 of 2024(5) dt.14-11-2024 2/2 allegedly committed by him, this Court is not inclined to grant regular bail to the petitioner. The application is dismissed."

Since learned counsel for the petitioner alleged delay in conclusion of trial, this Court called for a report from the learned trial court which has been received vide Letter No. 41/2024 dated 20th September, 2024. The learned trial court has reported that in this case, the evidence of all the prosecution witnesses have been recorded and thereafter statement of the accused has been recorded under Section 313 Cr.P.C.

5. Considering that the trial itself is on the verge of conclusion, this Court is not inclined to direct release of the petitioner on bail, particularly, considering the kind of criminal antecedents which he has got. The prayer is refused.

6. The learned trial court is expected to conclude the trial as early as possible preferably within a period of three months from the date of receipt/production of a copy of this order.

7. This application stands disposed of accordingly. (Rajeev Ranjan Prasad, J) lekhi/- U T
