1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Mufassil Police Station Case No. 290 of 2025, dated 28.08.2025, disclosing offences punishable under Sections 115 (2)/126(2)/117(2)/109(1)/351(2)/303(2)/ 352/ 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, as per the First Information Report, is that on 27.08.2025, at about 06:45 AM, the petitioners, along with other co-accused persons, having lathi and bricks in their hands, came, started abusing the informant
Patna High Court CR. MISC. No.88780 of 2025(2) dt.15-01-2026 2/3 and co-accused Sanjay Singh assaulted him by bricks on his head, due to which he sustained head injury. The petitioner no. 1 assaulted the informant by lathi on his hand. The petitioner no. 2 assaulted the cousin of the informant, Ajit, by lathi, on his left hand, due to which his left hand was broken.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case due to dispute relating to drainage. He further submits that both the parties are agnates. There is case and counter case between the parties and the case lodged by the side of the petitioner is prior in time to the present First Information Report. He further submits that the injured persons have received simple injuries, as would be evident from the injury reports.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that both the parties are agnates, there is dispute regarding drainage, case and counter case is also there and the case lodged by the side of the petitioners is prior in time to the present First Information Report and the injuries sustained by the victims are simple in nature, I am

6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Begusarai, in connection with Mufassil Police Station Case No. 290 of 2025, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
