JUSTICE JITENDRA KUMAR ORAL ORDER 09-12-2025 The present petition has been filed by the petitioner for cancellation of bail granted to Opposite Party No. 2, Harihar Jha @ Harihar Kumar Jha, vide order dated 08.10.2025 passed by this Court in Cr. Misc. No. 38074 of 2025.

2. From the order dated 08.10.2025, it transpires that as per the statement of Opposite Party No. 2, Harihar Jha @ Harihar Kumar Jha, he has only one criminal antecedent by way of Mahila P.S. Case No. 38 of 2019 whereas petitioner herein claims that he has concealed one criminal antecedent because he is an accused in Singhia P.S. Case No. 88 of 2023 registered for the offences punishable under Sections 341, 323, 379, 504, 506 read with Section 34 of the Indian Penal Code. The certified

3. Learned counsel for the petitioner submits that in view of concealment of one criminal antecedent viz. Singhia P.S. Case No. 88 of 2023, bail bonds submitted by the Opposite Party No. 2 before learned court below is liable to be cancelled in view of condition No. (i) in the order dated 08.10.2025.

However, without going into merit of submission of learned counsel for the petitioner, the present petition is disposed of giving liberty to the petitioner to move an application before learned court below and once such application is filed by the petitioner before learned court below for cancellation of bail bonds, the court below will decide it after hearing of Opposite Party No. 2, Harihar Jha @ Harihar Kumar Jha.

4. Accordingly, the present petition stands disposed of.
