2. The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 448, 427, 504, 506 of the Indian Penal Code and Sections 25(1), 27, 35 of the Arms Act.

3. As per prosecution case, on 12.08.2023 at about 10 PM, informant was walking after dinner, in the meantime, 5-6 persons came and started abusing him. The informant identified all the miscreants, who threatened and abused him. It is further alleged that accused persons, armed with pistol, warned informant to come out of house and when informant did not come out, accused persons fired 10 rounds with pistols in front of informant's house and also smashed the window of Alto K-10 car, which was parked outside his house.

4. Learned counsel for the petitioner submits that there is general and omnibus allegation against all the accused persons of firing and smashing the window of the car in question. There is delay of two days in lodging the F.I.R. Similarly situated co-accused persons have already been granted bail by this Court, vide order annexed as Annexure 2 series. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Aurangabad (Bihar) in connection with Nabinagar P.S. Case No. 335 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
