2. The petitioner seeks bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. As per prosecution case, on 25.12.2024 at about 8 AM in the morning, husband of the informant had gone to his wheat field. At the same time, all the F.I.R. named accused persons, equipped with gun, lathi and danda, surrounded informant's husband and thereafter, indiscriminately fired upon him from their respective fire arms hitting two bullets at the head of husband of informant and one bullet below his waist as a result of which, during course of treatment, husband of
Patna High Court CR. MISC. No.86718 of 2025(2) dt.17-12-2025 2/3 informant died.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired in this case during investigation merely on the basis of confessional statement of co-accused Sintu Kumar. Save and except confessional statement, there is no direct or indirect material against this petitioner to show his complicity in the alleged offence. Moreover, it is the specific case of the informant that the named accused persons caused death of her husband and she has not whispered or raised any suspicion against this petitioner. Charge-sheet has already been submitted and petitioner is in custody since 24.07.2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Madhepura in connection with
