Petitioner seeks bail in a case registered for the offences punishable under Sections 420,467,468,471,376 of the Indian Penal Code and Section 66(E) of the Information Technology Act.
The perusal of the entire FIR does not reveal that consent of the informant, who was already a married lady, was obtained by fraud by this petitioner. Hence, victim was a consenting party to the relationship with the petitioner. Learned A.P.P. for the State opposed the prayer for bail.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court CR. MISC. No.81153 of 2019(3) dt.18-03-2020 2/2 bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sahar Police Station Case No.224 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case as well as petitioner shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
