ANJANA MISHRA ORAL ORDER 10-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 06.07.2019, in connection with Kudhani P.S. Case No. 432 of 2019 for the offences under Sections 393, 413, 414, 120B/34 of Indian Penal Code and Sections 25(1-b)a, 26, 35 of Arms Act. Learned counsel for the petitioner submits that the petitioner is one of the persons who was found sitting in the Scorpio which was apprehended and such persons were taken into custody. Learned counsel for the petitioner submits that the only allegation against the petitioner is that two master keys were found from his possession and one steel knife. It is further submitted that similarly situated co-accused person Iltaf Ahmad who was also apprehended from the same Scorpio has since

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge III (West) cum Additional Chief Judicial Magistrate, Muzaffarpur, in connection with Kudhani P.S. Case No. 432 of 2019.
