1. Heard learned counsel for the petitioner and learned counsel for the informant - Opposite Party No. 2.
2. The petitioner apprehends his arrest in connection with Rohtas P.S. Case No. 188 / 2025 dated 05.09.2025 registered for the offence punishable under Section 85, 3(5), 88 of the B.N.S. 2023.
3. As per the F.I.R. marriage of the informant was solemnized with the petitioner according to Hindu rites and rituals on 01.06.2005 and it is alleged that the petitioner and his family members started demanding motorcycle and Rs. 1 lakh and due to non fulfillment of the said demand, the petitioner and other family members tortured the informant -Opposite Party
Patna High Court CR. MISC. No.91910 of 2025(5) dt.14-05-2026 2/3 No. 2 both physically and mentally and finally on 07.06.2025 the Opposite Party No. 2 was ousted from her matrimonial home.
4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. However, without prejudice to the right and contention of the petitioner and in order to maintain harmony in the family, the petitioner undertakes to pay a sum of Rs. 10,000/- per month to the Opposite Party No. 2 as "living cost" subject to the final outcome of the present case as well as matrimonial case, if any, pending and / or decided between the parties.

Learned counsel for the informant - Opposite Party No. 2 submits that the informant - Opposite Party No. 2 is at the verge of starvation, having no source of income, has two daughter to take care of and accepts the offer so made by the petitioner and submits that the petitioner may be directed to deposit the said amount of Rs. 10,000/- per month in the bank account of the informant - Opposite Party No. 2, details of which shall be furnished by learned counsel for the Opposite Party No. 2 to learned counsel for the petitioner within ten days from today.

6. After having heard learned counsel for the parties and taking into consideration the materials on record and the fact that offer made by the petitioner has been accepted by the Opposite Party No. 2, as such, I am inclined to grant privilege of anticipatory bail to the petitioner.
7. Let the petitioner, above named, in the event of his arrest / surrender before the learned court below within a period of six weeks from today be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri-On-Sone, Rohtas in connection with Rohtas P.S. Case No. 188 / 2025 subject to the condition as laid down under Section 482(2) of the B.N.S.S. as well as the following condition:- (i) that the petitioner shall deposit a sum of Rs. 10,000/- per month in bank account of the Opposite Party No. 2 positively by the 7th day of every month starting from the month of June, 2026.
