2. The petitioner seeks regular bail in a case registered for the offence under Sections 341, 323, 376, 511, 34 of the Indian Penal Code and Section 8/10 of the POCSO Act.
3. As per the prosecution case, one Intikhar is alleged to have tried to commit rape and the petitioner was standing outside.
4. Learned counsel for the petitioner submits that the police has exonerated the petitioner in the crime and has submitted final form. The Court has taken cognizance after differing with the final form. Petitioner is in custody since 11.07.2023.
5. Learned A.P.P. has vehemently opposed the
Patna High Court CR. MISC. No.1521 of 2024(2) dt.18-01-2024 2/2 prayer for bail.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-6th cum Special Judge POCSO Act, Sitamarhi/concerned Court below in connection with Pupri P.S. Case No. 355 of 2020 subject to the condition that:- 7(1). The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
