2. The petitioners are apprehending his arrest in a case in connection with Noorsarai P.S. Case No. 217/2024 dated 22.05.2024 registered for the offence punishable u/s 341, 323, 325, 307, 326, 504 and 506 read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioners and the co-accused persons holding weapons came to the house of the
2/4 informant and started abusing. On protest by the informant, the co-accused, Ravindra Ravidas exhorted to kill, thereafter, all the accused persons fired 10-15 rounds on the house of the informant. On 22.05.2024, when the informant's son went to attend call of nature, the accused persons assaulted him with lathi, causing injury and the petitioner no.1 (Badal Ravidas) exhorted to kill, then the petitioner no.2 (Lalo Ravidas) fired on the informant's son, causing firearm injury in his left thigh.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is case and counter case between the parties. The petitioners and the informant are co-villager. Learned counsel has further submitted that the injury of the informant's son is simple in nature caused by firearm. The petitioners have one antecedent as stated in para 3 of the bail petition. The co-accused persons have already been granted regular bail by this Court vide order dated 23.09.2024 passed in Cr. Misc. No. 62377 of 2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners by submitting that the specific allegation of firing is against the petitioner no.2, Lalo Ravidas. It is further submitted that the injured sustained
3/4 injuries which are evident from the injury report.

Considering the aforesaid facts and circumstances of the case, let the petitioner nos. 1 and 3 namely, Badal Ravidas @ Badal and Nitish Ravidas @ Nitish, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned court concerned, Nalanda, Biharsharif, in connection with Noorsarai P.S. Case No. 217/2024, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed with regard to the petitioner nos. 1 and 3 namely, Badal Ravidas @ Badal and Nitish Ravidas @ Nitish.

So far as, the petitioner no.2 namely, Lalo Ravidas is concerned, considering the heinous nature of allegation made against him in the F.I.R., I am of the view that no case for grant of anticipatory bail is made out, The petition is rejected and the petitioner no.2 (Lalo Ravidas) is directed to surrender to the Court below within six weeks from the date of this order and the Court below may consider the prayer of the bail of the petitioner on the same day without being prejudice by this order.

9. Accordingly, the application regarding petitioner no.2 namely, Lalo Ravidas is rejected.
