JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-12-2019 The petitioners seek bail in anticipation of their arrest in connection with Doriganj P.S. Case No. 175 of 2019, dated 04.09.2019, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. About 2.90 litres of liquor is said to have been recovered from the hut of one Narad Manjhi, who has named the petitioners. Thus for all practical purposes, the implication of the petitioners is on the basis of confession of an arrested accused person.
Petitioner Nos. 2 and 3 do do not have any criminal antecedents. However, petitioner No. 1 was made accused
Patna High Court CR. MISC. No.82866 of 2019(2) dt.13-12-2019 2/2 in one case in the year 2013 in which, he is on bail. The person from whose hut recovery has been made has been granted bail by a Bench of this Court.
Considering the aforesaid facts especially of no recovery from the possession of the petitioners, they, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. District Judge-XI at Chapra (Saran) in connection with Doriganj P.S. Case No. 175 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
