2. The petitioner seeks bail in connection with Bahera P.S. Case No. 104 of 2023 registered for the offence under Sections 341, 323, 504, 307, 506/34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is said to have fired at the victim which hit his leg.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case and he has committed no offence as has been alleged by the prosecution side.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 05.09.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Benipur, Darbhanga in connection with Bahera P.S. Case No. 104 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Bahera Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
