The petitioner seeks pre-arrest bail in connection with Sidhwalia P.S. Case No. 168 of 2019, registered under Sections 341, 323, 324, 325, 342 and 307/34 of the Indian Penal Code. The accusation is that Anil Kumar Sah, brother-in-law of the informant, Chandan Kumar Gupta, had come at the house of the informant and from there he proceeded to his house, Hathuar, Pipra. In the way, some persons moved claiming him to be the thief of child, started to cause assault in which Rama Manjhi, Rahul Kumar, Bhuali Miya (petitioner) and Krishna Ram were identified amongst the accused persons. Submission is that while petitioner is named in the first information report along with three others, who are said to be identified in the mob, but, six injuries were found on the person of the victim, which are simple in nature. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Sidhwalia P.S. Case No. 168 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VI, Gopalganj, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
