2. The petitioner seeks regular bail in connection with Nabinagar (Badem O.P) P.S. Case No. 420 of 2023 registered on 01.11.2023 lodged under Sections 307/302/379/411/353/333/332/427/120(B)/147/149 of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against seven named accused persons against whom there is allegation that they are the members of the illegal mining of sand and when police party reached there, they started fleeing away and in due course tractor dashed the police vehicle in which on chowkidar died on the spot.

4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner

5. Learned counsel for the State opposes the prayer for bail and submits that the petitioner is also the member of gang who are involved in illegal mining of the sand and everything has been done in connivance with each other.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, the bail application of the petitioner stands rejected.
