2. This application, for grant of anticipatory bail, arises out of Sonaki Police Station Case No. 120 of 2025, disclosing offences under Section 30(a) of Bihar Prohibition and Excise Act.
3. The prosecution case, as per the First Information Report, is that on 27.08.2025, at around 08:10 p:m, informant was on patrolling duty near the Tika Patti Gothi Dam paved road, saw that after seeing the police party, a man abandoned his black Honda Shine motorcycle bearing Registration No.
Patna High Court CR. MISC. No.86370 of 2025(2) dt.23-12-2025 2/3 BR07AB3195 near the paved road and succeeded in fleeing away. On search of abandoned motorcycle, total 600 ml country-made liquor packed in a plastic Mazza Bottle was recovered from the aforesaid motorcycle.
4. Learned Counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has come only on the basis of registered owner of the seized motorcycle bearing Registration No. BR07AB3195. Learned counsel next submits that his friend had borrowed the motorcycle for urgent work. Petitioner had no knowledge about the alleged recovery of illicit liquor. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is having no criminal antecedent.
5. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that petitioner is having no criminal antecedent and motorcycle was borrowed by petitioner's friend, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten
