The petitioner has prayed for bail in connection with Bhabua P.S. Case No. 493 of 2019 registered for the offence punishable under sections 379 and 411 of the Indian Penal Code and section 30(a) of Bihar Prohibition and Excise Act. As per allegation in the FIR, 33 litres of IMFL is said to have been recovered from a scooty. Petitioner was arrested while one another person managed to escape. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 3rd-cum-Special Judge Excise, Kaimur at Bhabua.
