JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-06-2020 Heard Mr. Yogesh Chandra Verma, learned Senior Advocate for the petitioner assisted by Mr. Javed Aslam, learned Advocate and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Daraunda P.S. Case No. 79 of 2019, dated 03.05.2019, instituted for the offences under Sections 341, 324, 307, 498A and 34 of the Indian Penal
Patna High Court CR. MISC. No.86644 of 2019(3) dt.19-06-2020 2/3 Code and Section 3/4 of the Dowry Prohibition Act. The petitioner is the husband of opposite party No. 2.
Mr. Yogesh Chandra Verma, learned Senior Advocate has informed this Court that a settlement has been arrived at between the spouses by virtue of which, the petitioner and opposite party No. 2 have agreed to live separately, but the grievances of opposite party No. 2 have been redressed.
Considering this aspect of the matter, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Siwan in connection with Daraunda P.S. Case No. 79 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
In case the aforesaid statement is not found to be
Patna High Court CR. MISC. No.86644 of 2019(3) dt.19-06-2020 3/3 true, it would be open for opposite party No. 2 to move a petition before the Court below for cancellation of anticipatory bail of the petitioner.
