2. The petitioners apprehend their arrest in a case registered under Section 420 of the Indian Penal Code.

3. As per prosecution case, these two petitioners sold the land of the complainant in favour of other accused persons.

4. Learned counsel appearing on behalf of the petitioners submits that petitioners are cousin father-in-law and brother-inlaw of the complainant respectively. Both parties are gotiyas. Petitioners have sold their own land. The land in question was in

Patna High Court CR. MISC. No.105 of 2025(2) dt.04-02-2025 2/2 peaceful possession of the petitioners. A title suit bearing Title Suit No. 74 of 2010 for the same piece of land is also going on between the parties. This complaint case has been filed only with a view to put pressure upon the petitioners. The dispute is purely civil in nature with respect to sale and purchase of land.

5. Learned A.P.P. appearing on behalf of the State opposed the bail application.

6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-I, Biharsharif, Nalanda, in connection with Complaint Case No. 118C of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
