2. The petitioner is in custody in connection with Gaurichak P.S Case No. 379 of 2025 registered for the offences punishable under Sections 309(6) of the BNS.

3. As per allegation in the FIR, petitioner along with the other co-accused persons have looted the Scorpio Vehicle of the informant bearing Registration No. BR-01CH-0786 while he visited a site.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from the possession of the petitioner. He further submits that charge-sheet has already been submitted against the petitioner. He further submits that

No.88505 of 2025(2) dt.22-12-2025 2/2 name of the petitioner has been figured during course of investigation on the basis of confessional statement of apprehended co-accused namely, Amit Kumar. He further submits that nothing adverse surfaced during investigation. It is also submitted that petitioner is in judicial custody since 25.06.2025 having two criminal antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order dated 11.11.2025, it appears that nothing has been recovered from the possession of the petitioner. Moreover, petitioner's name has figured from the confessional statement of the co-accused and taking into consideration that one of the co-accused has been granted bail by the co-ordinate Bench of this Court in Cr. Misc. No. 60014 of 2025, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Patna City in connection with Gaurichak P.S Case No. 379 of 2025.
