The petitioner seeks bail in connection with Baligaon P.S. Case No. 92/2019 for the offence under section 30(a) of Bihar Prohibition and Excise Act, 2018.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from an open place, which does not belong to this petitioner. The search and seizure list also lacks signature of any independent witnesses clearly suggests that petitioner has been made scape goat in the entire episode. Petitioner has no criminal antecedent. Petitioner is in custody since 16.09.2019.
