JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-03-2020 The petitioner, who is in custody since 17.06.2019, seeks bail in connection with Muzaffarpur Rail P.S. Case No. 130 of 2019, dated 16.06.2019, instituted for the offence under Sections 379, 356 and 411 of the Indian Penal Code and Section 8 and 20 of the N.D.P.S. Act.

Ten tablets of ativan, a psychotropic drug and a mobile phone is said to have been recovered from the possession of the petitioner. The petitioner has explanation for the possession of the same. He is a user of the aforesaid drug because of one of his legs was fractured and he required some relief from pain. The petitioner does not have any criminal

Considering the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Muzaffarpur Rail P.S. Case No. 130 of 2019.

The application stands allowed.
