The petitioner is in custody since 12.10.2019 in connection with Khutauna P.S. Case No. 107 of 2019 for the offence registered under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner but from the motorcycle which is alleged to be driven by the petitioner. It is further submitted that the alleged recoveries have been saddled on his shoulders and the petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.81364 of 2019(2) dt.11-12-2019 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ADJ- IIndcum- Special Judge (Excise) Madhubani in connection with Khutauna P.S. Case No. 107 of 2019.
