2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 354(D) of the Indian Penal Code and Sections 66(D), 67 of the Information Technology Act.

3. As per the prosecution case, petitioner is alleged to have posted obscene photographs of the informant on Facebook by creating a fake ID in the name of Ashif Khan.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that the alleged photographs have not been sent from the mobile of the petitioner and he has not created any fake Facebook ID. Petitioner has got clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Kothi P. S. Case No. 91 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
