The grievance of the petitioner is against the noncommunication of the order, which has rendered the petitioner helpless in filing the appeal before the Commissioner within the time.

Considering the fact that the order rejecting the application for grant of licence was not communicated, the Court disposes of the writ petition with the liberty to the petitioner to file an appeal before the Commissioner, Magadh Division, Gaya. In the event appeal is preferred by the petitioner within a period of 15 days along with a coy of this order, the

Patna High Court CWJC No.21617 of 2018(2) dt.01-05-2019 2/2 Commissioner, Magadh Division, Gaya shall examine the appeal on on the basis of materials available on record and shall not reject the same on the ground of delay.

With the aforesaid, the writ petition stands disposed of.
