JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This is an application for grant of anticipatory bail in connection with Banka P. S. Case No. 550 of 2019 disclosing offences under Sections 147, 149, 323, 324, 307, 354, 379, 504 of IPC.
As per prosecution case, there is allegation of demand and extortion and for that, assaulted the informant. Specific allegation is against petitioner no.1 of assault to Kishore Mandal by rod and against petitioner no.2 of assault to the informant by rod and petitioner no.3 of assault by rod to Manish, causing injuries.
Patna High Court CR. MISC. No.87117 of 2019(2) dt.23-01-2020 2/2 Submission of the learned counsel for the petitioners is that they are Pattidars. There was a land dispute between the parties. The injuries are simple in nature, except one injury caused to one Chandan Kumar Mandal which is attributed to the petitioner no.2 and the opinion about the same is kept reserved. Heard learned A.P.P. also.
Having heard both sides, considering the above submissions, so far petitioner no.2 is concerned, I am not inclined to grant privilege of anticipatory bail to him. He has to surrender and pray for regular bail.
So far other petitioners are concerned, let they in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Banka, in connection with Banka P.
