JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Excise Case No. C2A-01/2018 registered for the offences punishable under Sections 20(b) and 8(c) of the NDPS Act. The accusation against the petitioner is that 35 Kg. Ganja powder was recovered from the house of the petitioner but submission on behalf of the petitioner is that the aforesaid house is outer house of the petitioner and as a matter of fact, some unknown persons had kept the aforesaid seized articles and the petitioner was not aware about the keeping of the aforesaid seized articles.

Regard being had to the above stated facts and circumstances as well as submission of the parties, I am not
