Petitioner in the present case is seeking anticipatory bail in connection with Paroo P.S. Case No. 312 of 2019 registered for the offences punishable under Sections 147, 341, 323, 379, 504, 506 of the Indian Penal Code and Sections 30, 30(a), 37 (C) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to neigbourhood dispute and has no concern with the alleged recovery of half bottle of wine from the Tempo. It is further submitted that the Tempo from which the alleged recovery has been made does not belong to the petitioner.

Considering the facts and circumstances of the case, in the nature of the allegations made against this petitioner who is a female and the specific statement of the petitioner that she has no concern with the Tempo in which half bottle of wine has been recovered as also considering that this petitioner has been falsely implicated due to neighbourhood quarrel and dispute, let the petitioner above named in case of her arrest or surrender within a period of four weeks from today in connection with Paroo P.S. Case No. 312 of 2019 be released on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e. (i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
