The petitioners apprehend their arrest in connection with Nagar Sahayak P.S. Case No.348 of 2019, registered for the offence under Sections 323, 366(A), 504, 120(B) of the Indian Penal Code.

Initially, the informant filed a complaint Case no.2630 of 2018, which was forwarded to the police for registering the case. The informant has alleged that his minor daughter was enticed away by the petitioner no.4 Munni Devi with intention to solemnize her marriage.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.82377 of 2019(2) dt.12-12-2019 2/2 statement of the victim daughter of the informant was recorded under Section 164 of the Code of Criminal Procedure and she disclosed that she had left her house on her own volition and solemnized marriage with petitioner no.5 Sirtam Paswan voluntarily.

Taking into consideration the fact that victim is major girl and she had left her house on her own volition and solemnized marriage with petitioner no.5 voluntarily, petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Nagar Sahayak P.S. Case No.348 of 2019, subject to conditions, as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J.) nawalkrs/- U T
