The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Saharghat P.S. Case No. 37 of 2018 (G.R. No. 159 of 2018) registered for the offence punishable under sections 147, 149, 341, 323, 353, 447, 504 and 506 of the Indian Penal Code. As per allegation made in the F.I.R., as a result of killing of Shila Devi by her husband, there was a protest amongst the villagers in which a crowd of 150-200 villagers gathered and blocked the chowk/road and turned violent on seeing the police personnel. It is stated that amongst the antesocial elements gathered there, 11 persons were identified including the petitioner herein.

No.81651 of 2019(2) dt.11-12-2019 2/2 It is submitted by learned counsel for the petitioner that allegations are general and omnibus in nature and a number of co-accused have been enlarged on bail including Rajendra Mandal vide order dated 21.10.2019 passed in Cr. Misc. No. 63447 of 2019.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including grant of bail of co-accused, this Court is inclined to grant bail to the petitioner and he is directed to surrender in the court below within a period of six weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Benipatti, Madhubani in connection with Saharghat P.S. Case No. 37 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
