The petitioner is seeking anticipatory bail in connection with Chandradeep P.S. Case No. 84/2019 registered under Sections 147, 148, 149, 302 of the Indian Penal Code, pending in the court of learned A.C.J.M. - 01, Jamui. Learned counsel for the petitioner submits that no specific allegation of overt act is against the petitioner, the petitioner is the Tempo driver.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case wherein it is the allegation against the petitioner that all the assailants had come on the place of occurrence on the Tempo which was being driven by this petitioner and in the First

No.79904 of 2019(2) dt.05-12-2019 2/2 Information Report this petitioner has been specifically named as one of the accused who had assaulted the son of the informant who ultimately died and further that petitioner has got a criminal antecedent also, this court is not inclined to grant privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is, thus, refused.

In case, petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered by the court below on it's own merit without being prejudiced by the order of this court.
