2. The petitioner is in custody since 23.07.2019 in connection with Jainagar P.S. Case No. 354 of 2019 for the alleged offences under Sections 302, 201, 120(B) of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated merely on the footing that the petitioner along with other co-accused were last seen with the deceased, but except suspicion there is no other objective material to connect the petitioner with the alleged occurrence. It is further submitted that land dispute, if at all, was between the deceased and the co-accused Md. Ahsan Rayeen and not with the petitioner. The petitioner claims clean antecedents.

4. Learned APP on the other hand submits on the basis of case diary that the petitioner is specifically named as the person on whose motorcycle the deceased had gone away.

5. Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant the privilege of bail to the petitioner. The petition stands dismissed.
